Rental Agreement and Customer Information

Pursuant to Article 13 of European Regulation 679/2016 and payment terms – Bicycle rental

Privacy Policy

Purpose of processing: personal data, contact details, bank details, address, identity card: necessary for contractual obligations (Article 6, letter b and c of Regulation (EU) 679/2016).

Data recipients: administrative and sales offices; professionals or service companies for administration, business management, and legal consultancy who work in collaboration with our company.

Expected cancellation terms: ten years

Processing methods: password-protected electronic tools

Data subject rights (pursuant to Article 13, point 2 of Regulation (EU) 679/2016) may be exercised by contacting the data controller using the methods listed in point 1:

  • a) access to personal data
  • b) rectification or cancellation of the same
  • c) opposition to processing
  • d) data portability
  • e) revocation of consent
  • f) complaint to the supervisory authority, for Italy the Privacy Guarantor

Payment Terms

Payment Methods: Payment can be made electronically or in cash at the time of booking. For online bookings, only electronic payment is accepted.

Cancellation Policy

Cancellation due to bad weather: In the event of rain on the day of rental, before the scheduled start time (9:00 am), or in the event of other adverse weather conditions that make it impossible or unsafe to carry out the activity (e.g. strong winds), as reported in official bulletins from ARPAE or the Civil Protection Agency, the customer will be entitled to a full refund of the amount paid.

Cancellation for other reasons:

  • Cancellation within 48 hours of the start of the rental (9:00 a.m. on the booked day): full refund or, upon request, voucher of equal value to be used within 12 months from the date of issue.
  • Cancellation between 48 and 24 hours before the start of the rental: 50% refund of the amount paid.
  • Cancellation within 24 hours of rental start: no refund.

Cancellation Policy: Any cancellation request must be communicated exclusively by email to info@comacchioexperience.com. For the purposes of applying the refund terms, only the date and time of the email sent by the rental company’s email system will be valid.

Penalties and Special Conditions

Incorrect sizes: It is the customer’s responsibility to provide the correct size information at the time of booking. If the sizes indicated are incorrect, the rental company undertakes to offer alternative items, subject to availability. If suitable alternatives are not available, the customer will not be entitled to a full or partial refund.

Late return: The rented equipment must be returned by the agreed time.

  • Delays of up to 1 hour: €15.00 penalty.
  • Delays exceeding 1 hour: a flat penalty of €50.00, without prejudice to the rental company’s right to request compensation for further damages.
  • The penalty is due regardless of the reasons for the delay, except in duly documented cases of force majeure.

Rental Regulations

  • Rental and use of the bicycle presupposes knowledge and unconditional acceptance of these regulations, the rates, and the Rental Company’s opening and closing times.
  • To obtain the rental, the Customer must present a valid identity document and formalize the contract.
  • Bicycles may only be ridden by adults, unless the minor is accompanied by an adult (parent or guardian) who assumes full responsibility for them.
  • By renting a bicycle, the Customer declares to have adequate technical ability and competence, holding the Rental Company harmless from any consequences. Wearing a helmet is recommended (unless required by law).
  • Bicycles should be used exclusively as a means of transportation, with caution, common sense, and diligence. Use for commercial purposes or leasing them to others is prohibited.
  • The Customer is responsible for the bicycle until it is returned, as well as for any damage caused to themselves, the bicycle, third parties, or property while using the vehicle. The Rental Company cannot be asked for any form of compensation.
  • During the rental the Customer does not benefit from any form of insurance nor is the bicycle covered by third party insurance. The Customer is required to respect the rules of the Highway Code.
  • The Rental Company has taken out a suitable Insurance Policy for any damages incurred by the Customer for reasons attributable to the lack of or incorrect maintenance of the vehicle attributable to the Rental Company.
  • The Rental Company may carry out checks during use of the bicycles and request their return in the event of improper use. The Rental Company may refuse to rent to anyone who is intoxicated or under the influence of drugs.
  • In the event of loss of keys, accessories or damage, the Rental Company will request from the Customer the sum necessary to restore the vehicle to its original condition, based on the attached price list, except for any further documented damage.
  • The bicycle must be returned within the specified timeframe and to the same location where it was rented. Failure to return the bicycle without prior notification will result in legal action being taken.
  • The Customer must pay the fee in advance and is required to pay any additional sums due for holding the vehicle beyond the requested time, in addition to any charges for damage or theft.
  • In the event of theft, the Customer must file a report with the Rental Company, specifying the location, time, and manner of the incident, and provide full cooperation.
  • In the event of theft, the Customer is required to reimburse the damage to the Renter on the basis of what is indicated above.
  • For anything not provided for in this contract, the relationship between the Parties is governed by the provisions of the Civil Code. For any dispute, the court of Ferrara has exclusive jurisdiction.
  • The Customer declares to have been informed that the personal data provided will be processed in compliance with European Regulation 2016/679 (GDPR).
